Fundraising Terms and Conditions

Each and every day, all over the world Make-A-Wish® brings amazing people together to grant life-changing wishes for children with a critical illness. As an organisation who receives no government funding for our wish program, we rely on the generosity of the community to help us raise vital funds for our important mission. All fundraising activities we undertake must reflect the Make-A-Wish values and we all have a collective responsibility to ensure we live up to them.

Terms and conditions

We have created the following terms and conditions to support and protect you while you fundraise for Make-A-Wish. It’s important that you take the time to understand and follow these guidelines. If there is anything in the list below that you don’t understand, please call us to talk it through. You should not proceed if there is any part you do not understand. It’s important that you take the time to read all of these requirements before you get started. You should carefully plan your activity from beginning to end with a full understanding of your responsibilities throughout.

Before

  1. We need to authorise you to collect funds on our behalf. The first step is to put in an application for approval of a fundraising event. Once you have confirmation of our approval, we will provide you with a document called an ‘Authority to Fundraise’. This document is your proof that you are running a legitimate Make-A-Wish fundraiser.
  2. To be authorised to run a fundraising initiative, you need to be over the age of 16 at the time you make your application.
  3. We need to be able to manage the types of activities, events or donations we will accept, so you will understand that if we believe anything you are proposing is inconsistent with our mission, values, objectives and branding, we may decline permission.
  4. By the act of lodging an application to run a fundraising initiative, you confirm that you don’t have any prior criminal convictions or current criminal cases against you. If you have any, the general rule is that you cannot run an initiative for us, however please speak to us as this may not necessarily prevent you from helping us, we will review each case on its own merits for people who would like to talk to us about it.
  5. You shouldn’t use your approval as a fundraiser or your association with our organisation for your own personal gain.
  6. While we don’t mind you using our brand to promote your own business via a fundraising initiative, you need to ask us for permission first. In addition, if you are undertaking a promotion in which you donate a percentage or a dollar amount related to a sale or sales, you need to be very clear about the percentage or dollar amount so that a member of the public can clearly identify how much of their purchase price is going towards the Make-A-Wish cause.
  7. You need to be careful not to undertake, and we will definitely not approve, any activity or initiative that might even foreseeably align Make-A-Wish with any matters related to politics, firearms, alcohol or tobacco organisations or any X-rated or violent content, or any other objectionable materials. As you would expect, we will always decline any requests for approvals for these things. All activities need to be G rated.
  8. If what you are proposing would include specific involvement by Make-A-Wish or any of its staff, you need to make this very clear at the time you submit the proposal in relation to your initiative. That way we will be able to consider in the context of the whole initiative and respond to that request before you make any commitments or other plans.
  9. You must not use door-to-door fundraising methods in any of your initiatives.
  10. It’s possible that you will need a permit for what you are proposing in your fundraising activity. You should include as much information as you can about your initiative when you fill in your approval application form so that we can give you guidance on what you may require in this regard to run your initiative. You should also check with the relevant authority, some of which appear in the list at the end of this document, and also check with your local council to ensure that you do not require any permits such as those required to serve food alcohol, hold an event in public or to conduct any aspect of your fundraising initiative.
  11. Even approved initiatives will not be covered by our insurance. If your initiative will be conducted at a venue, it is possible that the venue provider may have insurance coverage that extends to you in using their facilities. You should make enquiries directly with the venue provider about this.

During

  1. If you change anything about your fundraising initiative after receiving your approval from us, you have to let us know. It may result in an alteration of our approval.
  2. You can’t use any of the Make-A-Wish intellectual property, including the name and logo, on, or being related in any way to any products or services unless you have obtained our written permission first. Each request will be considered on its own merits.
  3. Your initiative is entirely yours, Make-A-Wish will not have any financial responsibility for or involvement in your fundraising initiative except for approvals as set out in these terms and conditions or other guidance we are able to provide.
  4. Any time you want to use the Make-A-Wish name, the “proudly supporting” logo or any other intellectual property on any materials that relate to your fundraising activity, you need to get our prior approval. If you want any of our logos, you should ask for them via email. Even though we may provide the logos to you, this does not mean that we have approved your use of the logo, you still need to submit the relevant media containing the logo (or other materials we provide) to us for approval. We just need you to send the material to us, via email, for us to review and approve. You don’t have to wait for all of your material to be ready, you can send it through in separate emails. That way, you can take into account any changes we require when you are putting together the rest of your materials.
  5. It’s important that you don’t make any statements on behalf of Make-A-Wish or that would reasonably appear to anyone that they came from an official Make-A-Wish representative.
  6. It’s important that any messages we use in public promotion (through both digital and traditional channels) are consistent. We can provide you with messaging and imagery to help with your promotions and it’s important that we are able to review any materials before they are released. You need to let us know of any public relations opportunities such as attendance by the media, celebrities, politicians etc.
  7. Sometimes people are motivated to fundraise for Make-A-Wish due to an experience they have seen someone go through. If you want to talk about that, especially in a public forum or in your publicity materials, you need to seek that person’s permission, or permission from their parent / guardian / next of kin to make reference to their experience. We all need to respect that some people may not want their experience to be made public so it’s very important that we keep this in mind and consider the impact on and respect the wishes of others, particularly those who have been part of the wish program at Make-A-Wish.
  8. Make-A-Wish can revoke any approval, authority or other verification of your activity at any time if we think that what you are planning, doing or what might result from that could in any way negatively affect the image or reputation of Make-A-Wish. We can also revoke or withdraw all or part of an approval or consent if we believe for any reason that you might not be able to meet any of these terms and conditions.
  9. There will often be questions about the tax deductibility of any donations made via your fundraising initiative. In broad terms, all monetary donations made directly to Make-A-Wish over $2 are eligible for a tax deductible receipt. Please be aware that tax deductible receipts can’t be issued or provided for the following because they do not fit the ATO’s definition of tax deductible expenditure:
  • Purchase of ticket to attend a Make-A-Wish fundraiser.
  • Purchase of a good or service related to a Make-A-Wish fundraiser.
  • Purchase of raffle tickets.
  • Purchase of an auction item.
  • Goods or services donated for a fundraising event or activity.
  • Monies raised and/or donated on behalf of others.
  • There may be other things we haven’t thought of!

10. Everyone who makes a donation over $2 via your registered Make-A-Wish online fundraising page will automatically be issued with a receipt from Make-A-Wish that will be in a tax-deductible form. If a person offers a donation at any of your events or initiatives and requires a receipt, it is best that you refer them to your online fundraising page for the donation to be made and a receipt to be issued that way.

11. The initiative needs to be concluded by the date we approved on your application.

After

  1. You need to remit to Make-A-Wish the net proceeds you collected for us from your fundraising initiative within 14 days of its completion. If you need more time for any reason, contact us to discuss.
  2. It’s really important that we are transparent when it comes to our finances. We all need to keep costs as low as possible when you’re fundraising. Your costs should never exceed 40% of your income, and you should aim for much lower.
  3. You acknowledge that you are undertaking all fundraising activities for the benefit of Make-A-Wish and not for your own benefit.

Complying with the law

  1. As with everything in life, we require our fundraisers to comply with the law. This includes the law relating to fundraising, obtaining appropriate licenses (if required) for raffles and other fundraising activities. It also includes more general things like making sure you are not misleading or deceiving people and all other behaviour or actions that would put you in contravention of any legal requirement or prohibition. A lot of our other rules set out in this document are based on legal requirements, so don’t take this section as being the full extent of what is required to comply with the law.
  2. The privacy of everyone involved with Make-A-Wish is very important. Because of this, we need you to understand fully that by conducting a fundraising initiative, you are obliged to comply with all laws, including privacy laws. You have to comply with all law, whether state, Commonwealth, or otherwise in relation to all personal and sensitive information that you collect or come into contact with.
  3. By submitting photographs or other information relating to your initiative, you give consent for these things to be published online or in publications by Make-A-Wish at any time.
  4. By providing photographs or other information to Make-A-Wish, you are representing to us that you either have all rights to, or you’ve obtained the necessary consents or releases from the subjects of the photographs or providers / contributors / owners of the other information you give us, including your own consent. We may publish this material on our website and / or any other method of publication now or in the future.
  5. By registering as a fundraiser, you give us your consent to use and disclose your personal information to our agencies and other third parties that we might engage from time to time in connection with fundraising activities and the purposes set out in our privacy policy.
  6. Any consent you give under these Terms and Conditions does not automatically cease if you cease being a fundraiser, so if there is a reason you would like us not to use any image or other material you have provided, you should contact us to discuss.
  7. You will find below a list of organisations you are able to contact to seek more information about fundraising legislation in your state or territory. The list is not exhaustive, so please feel free to do further research on your initiative. You also need to make sure that you comply with local regulations such as liquor licensing, food preparation, raffle, auctions and all other activities that require legal compliance.
